1) Eligibility (17+)
The App is intended for users aged 17 and above. By using the App, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) Acceptance of these Terms
By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
3) About Feysiora
Feysiora helps you keep beauty appointments and care sessions organized in one place. You can track appointments (service, salon details, date, notes), review a chronological care timeline, view simple cost statistics, and search or revisit archived records.
4) Account registration and security
You may be required to create an account and provide information such as name, username, and email.
- You are responsible for maintaining the confidentiality of your account and for activities that occur under your account.
- You agree to provide accurate information and keep it up to date.
- You must notify us promptly if you suspect unauthorized access to your account.
5) Your content and submissions
You may submit content to the App (for example, notes, appointment details, photos, and support messages) ("User Content").
- You retain ownership of your User Content.
- You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, and process User Content solely to operate, provide, maintain, and improve the App and to provide customer support.
- You are responsible for your User Content and represent that you have the necessary rights to provide it.
6) Acceptable use
You agree not to:
- Use the App in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to the App or related systems.
- Interfere with or disrupt the App (including by introducing malware, scraping, or abusing APIs).
- Reverse engineer, decompile, or attempt to extract source code except where prohibited by law.
- Use the App to infringe the rights of others (including privacy, publicity, or intellectual property rights).
7) AI-assisted features (if available)
If the App offers optional AI-assisted features, you control whether to upload content and whether to generate outputs. You agree not to upload content you do not have the right to use, and you understand that outputs may not be error-free and should be reviewed before you rely on them.
8) Intellectual property
The App and all associated content and technology (excluding your User Content) are owned by Feysiora Team or its licensors and are protected by intellectual property laws. You may not use our trademarks or branding without our prior written permission.
9) Third-party services
The App may rely on third-party services (for example, infrastructure, analytics, or crash reporting) to operate and improve the App. Your use of such services may be subject to their terms and policies. We are not responsible for third-party services that we do not control.
10) App Store terms (Apple)
If you downloaded the App from the Apple App Store:
- These Terms are between you and Feysiora Team, not Apple.
- Apple has no obligation to provide maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple will have no other warranty obligation.
- Apple is not responsible for addressing claims by you or any third party relating to the App or your possession/use of the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection or similar legislation.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
11) Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the App will be uninterrupted, secure, or error-free, or that any records, timelines, or statistics will be accurate or complete.
12) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEYSIORA TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEYSIORA TEAM'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13) Indemnity
You agree to indemnify and hold harmless Feysiora Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms or applicable law.
14) Suspension and termination
We may suspend or terminate your access to the App if we reasonably believe you violated these Terms, created risk for us or others, or where required by law.
You may stop using the App at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution.
15) Changes to these Terms
We may update these Terms from time to time. We will update the "Effective Date" above when changes take effect. By continuing to use the App after changes take effect, you agree to the updated Terms.
16) Governing law and dispute resolution (binding arbitration)
These Terms are governed by the laws of the jurisdiction where Feysiora Team is primarily established, excluding its conflict of laws rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the App will be resolved by binding arbitration in that jurisdiction, except that either party may seek relief in small claims court (if eligible) or seek injunctive relief to protect intellectual property or prevent unauthorized access.
